Phone Messaging Policy (SMS Compliance & Sending Limits)

Kyrios enforces strict SMS compliance rules, consent requirements, and sending limits to protect deliverability, prevent spam, and ensure accounts remain compliant with A2P messaging regulations.

Phone Messaging Policy Overview

Kyrios requires all SMS sent through the platform to comply with applicable laws, carrier standards, and A2P messaging guidelines.

This policy exists to:

  • Prevent SMS spam from fake or low-quality signups

  • Avoid account blocks caused by suspicious messaging behavior

  • Reduce legal risk from messaging non-consenting recipients

All SMS sent through Kyrios—regardless of number type (long code or toll-free)—must follow this policy.


Consent Requirements (Opt-In)

What Is Required

  • SMS may only be sent to contacts who have explicitly opted in

  • Consent cannot be bought, sold, or transferred

  • Purchased or scraped phone lists are not allowed

Key Rule

SMS must only be sent to contacts who knowingly consented to receive messages from your account.


Revocation of Consent (Opt-Out)

Mandatory Opt-Out Language

Every initial outbound SMS must include opt-out instructions such as:

“Reply STOP to unsubscribe”

Contacts must be able to revoke consent at any time using standard opt-out keywords.

What Happens After Opt-Out

  • The contact is placed under Permanent DND

  • All queued and future SMS to that contact will fail


Sender Identification Requirements

Sender ID Rule

Each initial message must clearly identify the sender (the party that obtained consent).

Kyrios automatically appends sender identification in this format:

“Thanks, <Location Name>”

Follow-up messages in an ongoing conversation are exempt.


Prohibited Messaging Content

You may not send SMS related to:

  • Alcohol

  • Firearms

  • Gambling

  • Tobacco

  • Adult content


Filtering Evasion & Spam Prevention

Kyrios strictly prohibits:

  • Intentionally misspelled words to bypass filters

  • Non-standard opt-out phrases

  • Snowshoeing (spreading similar messages across many numbers to evade detection)


SMS Ramp-Up Model (New Accounts)

All new accounts using the Phone System (from February 1, 2024) follow an 8-level ramp-up model.

How the Ramp-Up Works

  • The ramp begins when the first successful SMS is sent, not at signup

  • All accounts start at Level 1 (100 SMS / 24 hours)

  • To unlock the next level:

    1. Send the full daily limit within 24 hours

    2. SMS sending is temporarily disabled for the next 24 hours

    3. After 24 hours, the next level unlocks

This process repeats until Level 8.


SMS Limit Error Messages

Conversation Error

“You have exceeded your SMS sending limit.”

Bulk Action Error

“You are allowed to send 5000 message(s) in a day. You have already sent 5000 message(s). If you wish to proceed, 1 message(s) will be failed.”


Spam Message Handling & Message Statuses

Each SMS may appear in one of four states:

  • Delivered – Successfully delivered to the contact

  • Sent – Sent to the carrier, delivery response pending

  • Failed – Not sent or canceled

  • Undelivered – Blocked due to policy or carrier rules

Kyrios evaluates Undelivered messages to improve future deliverability.

  • Applied automatically

  • Can be revoked by an account admin

Permanent DND

  • Applied when contact opts out or cannot receive SMS

  • Cannot be removed from the UI


Revoke DND for a Contact

  • Open the contact record

  • Remove the DND flag

    • START

    • YES

    • UNSTOP

If DND is not removed after this, contact support.


Opt-Out Language Enforcement

What Kyrios Automatically Adds

For Bulk SMS only, Kyrios appends:

“Reply STOP to unsubscribe”

This does not apply to:

  • Workflows

  • Campaigns

  • One-on-one conversations

Customize the Opt-Out Message

You can customize opt-out language here:

If your message already contains a valid opt-out keyword, Kyrios does not append another.


Error Rate & Opt-Out Rate Monitoring

Kyrios actively monitors account health.

  • All outbound SMS fail until 00:00 UTC

  • One-on-one conversations and test SMS are still allowed


What To Do After a Violation Email

  1. Stop all workflows, campaigns, and bulk actions to non-opted-in contacts

  2. Enable and customize Sender ID and opt-out language

  3. Avoid bulk blasts or cold SMS campaigns


Common Issues and Fixes

Cannot Send SMS – DND Active

Error: “Cannot send messages as DND is active for SMS.”

Fix:

  • Temporary DND: Remove from contact record

  • Permanent DND: Contact must opt back in via keyword


FAQ

How often does the SMS limit reset?

Every 24 hours. After Day 8, the limit caps at 5000 SMS daily.


How can I send more than 5000 SMS per day?

After reaching Day 8, contact your Account Manager with the subject:
Increase SMS Daily Limit

Include:

  • Account name

  • Requested limit

  • Use case


Can we respond to replies after hitting the daily limit?

No. Manual, automated, and bulk SMS are all restricted during the limit window.


Can DND be removed in bulk?

No. DND removal must be handled per contact to protect compliance.


Does sender ID and opt-out language apply to workflows or manual SMS?

No. This feature applies only to Bulk SMS.
